Software Duplication Rights

Does SwiftCD have software that I can add to my CD?

No, we do not maintain a stockage of general use software.  You must provide all items for your data CDs.  In addition, when you sign up for our services and agree to our terms of service, you certify that you have full rights to reproduce the software that you submit to us for duplication.  That includes executable files, images, database files, or anything else that you provide to us.

Music Duplication Rights

a.      Does SwiftCD have a stockage of music from which I can assemble a music CD?

No, we do not maintain an inventory of licensed music for you to assemble a music CD.  You are responsible for obtaining all rights to any music that you submit to us for duplication.

b.      Where should I go to get information on licensing music?

This site has good general information about music licensing and copyrighting, as well as many links to additional music licensing resources.

There are many companies and web sites who will assist you in acquiring rights to music.  Many of them even have their own libraries of licensed music for you to pick from.  If you perform a meta-search on "music license", you should get all the results you can use.

c.      What is public domain music, and where can I find out more about it?

Generally speaking, public domain music in the United States is music originally copyrighted prior to and including 1922.  Public domain music is free for anyone to use as they wish.  DISCLAIMER: this is NOT legal advice.  If in doubt, always seek legal advice. Visit the U.S. Copyright Office's website for more info. Please note that although the source music itself may be in the public domain, such as "Jingle Bells" written in 1857, the specific recording you are considering may not be in the public domain, such as the version of "Jingle Bells" recorded by Kenny Rankin in 1999.

This site is a good source of information on public domain music, and includes a list of music in the public domain.

Another listing of public domain music.

Excellent site to look up the current ownership and licensing requirements for specific songs.

Dormant and Inactive Accounts

Because (1) most customers who abandon their accounts do not notify us, and (2) we do not have unlimited storage space, we have adopted the following policy concerning dormant and inactive accounts:

a.  if 6 months go by without an order, we will consider the account dormant, we will inactivate order forms (if applicable), and we will archive contents and artwork

b.  if 12 months go by without an order, we will consider the account inactive (abandoned), and we will delete all content and artwork from our servers.  We will also dispose of any master CDs or DVDs, as well as any fulfillment items in our warehouse

c.  For new customers at least 6 months old and have never placed an order, we will consider the account inactive (abandoned) and delete any content and artwork that was uploaded to our servers

Refunds, Returns, and Replacements Policy

It is our policy to replace defective products at no additional charge to our customers.

If a purchaser reports to you that (1) a shipment has been damaged in transit, or (2) they have not received a CD that we shipped (after 3 weeks to a US address, 4 weeks to a non-US address), we will send another CD at no additional cost to the same address, up to two months after the original shipping date.  (If you wish to change the address, we will treat it as a new order, for which we will charge you the full amount).  The maximum quantity of these free replacements is 1% of the monthly volume.  If you request replacements in excess of the 1% limit, we will charge you the full amount.  If the original shipment was sent via Priority Mail, we will charge you for the Priority Mail charges on the second shipment as well.

This replacement policy does not apply in the following situations, if you choose a non-tracked shipping method:

a.  Your shipment contains five or more CDs/DVDs

b.  Your shipment contains a Fulfillment Item

c.  Your shipment contains special packaging provided by you

To safeguard your shipments, please use a tracked shipping method. Details here.

If a CD has been returned to us, we will notify you of the return, and the reason for the return, if available.  We will hold the returned CD for one week.  If you wish us to send it again to the consumer at a new address, we will charge you half the normal CD price (minimum 2.50), plus shipping.

If a Fulfillment Item has been returned to us, we will notify you of the return, and the reason for the return, if available.  We will return the item to your inventory so that it can be used for future shipments.  If the item is returned in unusable condition, we will will notify you and let you decide how to dispose of the item.

We do not issue refunds.

Manual Processing Fee

This fee applies to orders that we must manually fix, because of errors in the order that you sent to us.  We will let you know when these errors first occur in your orders, to give you a chance to fix the problem.  If they continue to happen, we will apply a 2.00 Manual Processing Fee.

Here are some examples of when a 2.00 Manual Processing Fee may be applied to your orders:

a.  You order an invalid ProductId from us.

b.  You ask us to enter an order into our system for you.  (Click here to see the many methods we offer for you to send orders to us.)

c.  You ask us to change elements in an order that you have already submitted, such as the Shipping Address.

d.  You send an invalid download URL as part of an order.

e.  You send an order with missing elements, such as ProductId or Shipping Address.

f.  You ask us to reship another copy of an existing order, but the order does not meet the free replacement policy standards.

Browser Support on This Website

We continue to make every effort to make our web site compatible with every browser in use, but keeping up with all browsers all the time is virtually impossible.

As far as we know, all of our pages are fully functional with Internet Explorer, NetScape, FireFox, and Opera.  Our upload functions are not functional with Safari, because of documented problems associated with Safari's javascript interaction with the html <form> object.  Unless enctype="multipart/form-data" is specified in the form object at the time the page is loaded, Safari is unable to encode the file per the RFC 1867 specification.  Changing the enctype at runtime via Javascript is supported in Internet Explorer, Netscape, Opera, Firefox and every other Java-enabled browser we know of, with this one exception of Safari on Macintosh.

If you experience browser-related problems on any of our pages other than the Safari problem above, please let us know, and we'll get it fixed as soon as we can.

Mac Users

a.   Can you take my StuffIt files?

Yes, you can send us your SIT files

b.   Can I send you a Mac CD image file?

Yes, just stuff your Mac CD *.dmg file and upload it.  IMPORTANT:  You must send us an e-mail and let us know that you have sent us a CD image.  Otherwise, we will simply unstuff your SIT file and write the resulting DMG file to the root of the CD.
